Collection and Storage of Personal Data as well as Type and Purpose of their Use

a) During the visit to the website

If you access our websites www.djamacat.com, www.djamacat.de, www.aquaryouns.games, www.aquaryouns.com the browser used by your terminal device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. In the process, the following information is captured without any action on your part and stored until it is automatically deleted:

  • IP address of the computer making the request,
  • Date and time of access,
  • Name and URL of the accessed file,
  • Website from which the access is made (referrer URL),
  • Browser used and, if appropriate, the operating system of your computer as well as the name of your access provider.

The data listed above are processed by us for the following purposes:

  • To ensure a smooth connection to the website,
  • To ensure the convenient use of our website,
  • Evaluation of the system’s security and stability as well as
  • for other administrative purposes.

The legal basis for the data processing is Art. 6 (1), sentence 1 (f) GDPR. Our legitimate interest arises from the above-mentioned purposes for data collection. We do not in any circumstances use the collected data for the purpose of identifying you.

In addition, when you visit our website, we use cookies as well as analysis services. More detailed explanations in this respect can be found in clauses 4 and 5 of this data protection declaration.

b) Setting up a user account

You require a user account to use our services. We require the following data from you, in order to clearly identify you during the performance of the contract (execution of your order, delivery of the goods, credit check, payment processing, prevention of fraudulent use of our website, to inform you about your orders, products and offers);

  • E-mail
  • Player name and password
  • Profile information (such as profile picture)

c) At the registration for our newsletter

If you have expressly provided your consent in accordance with Art. 6 (1) (1) (a) GDPR, we use your e-mail address to send our regular newsletter to you. If you wish to receive our newsletter, it is sufficient to provide us with your e-mail address.

You can unsubscribe at any time, for example via the link at the end of each newsletter. Alternatively, you can send your request to cancel at any time by e-mail to contact(at)djamacat.com.

d) Support requests

If you have any questions, you have the option to contact us by means of a support system. We require a valid e-mail address and the player name to establish who is making the enquiry and to enable us to respond. Any further information is optional.

The data will be processed for the purpose of making contact in accordance with Art. 6 (1) (1) (a), GDPR on the basis of your voluntary consent.

The personal data collected by us for the utilisation of the support system is automatically deleted after your query has been resolved.

Disclosure of Data

Your personal data is not disclosed to third parties for any purposes other than those listed below.

We only disclose your personal data to third parties, if:

  • you have provided your express consent in accordance with Art. 6 (1) (1) (a) GDPR,
  • there is a legal obligation for the disclosure, in accordance with Art. 6 (1) (1) (c) GDPR, as well as
  • this is legally permissible and required for the handling of the contractual relationship with you in accordance with Art. 6 (1) (1) (b) GDPR.

Cookies

We use cookies on our website. These are small files, which are automatically created by your browser and stored on your terminal device (laptop, tablet, smartphone or similar), when you are visiting our website. Cookies do not cause any damage to your terminal device, nor do they contain any viruses, Trojans or other malware.

Information is filed in the cookie, which arise in each case in connection with the specific terminal device that is being used. This does not, however, mean that we automatically receive information on your identity.

The use of cookies serves on the one hand to provide you with a more convenient way of using our offering. We thus use so-called session cookies to see that you have already visited individual pages of our website. These are automatically deleted after you leave our website.

We also use temporary cookies, which are stored on your terminal device for a specific determined period of time to optimise the user-friendliness. If you revisit our website to use our services, it will automatically be recognised that you have already visited us, which entries you have made and which settings you have selected, so you are not required to enter these again.

On the other hand, we have used cookies to statistically capture the use of our website and to evaluate the use for the purpose of optimising our website for you (see Cl. 5). These cookies are automatically deleted after a period of time that is specified in each case.

The date processed by means of cookies are required for the specified purposes for the protection of our legitimate interests as well as of those of third parties, in accordance with Art. 6 (1) (1) (f) GDPR.

You can, however, configure your browser in such a way that cookies are not stored on your computer or that a notice will appear each time before a new cookie is set. The complete deactivation of cookies can, however, result in a reduced functionality of our website, and you may not be able to use all the features of our website.

Analytical Tools

a) Tracking-Tools

The tracking measures listed below and used by us are taken on the basis of Art. 6 (1) (1) (f) GDPR. We intend to ensure the appropriate presentation and continued optimisation of our website with the tracking measures that are being applied. On the other hand, we have applied tracking measures to statistically capture the use of our website and to evaluate such use for the purpose of optimising our offering for you. These interests are legitimate and to be considered in line with the above mentioned provisions.

The respective purposes for data processing and data categories can be found in the corresponding tracking tools.

I) Google Analytics

For the purpose of the appropriate presentation and continued optimisation of our websites, we use Google Analytics, a web analysis service provided by Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter "Google"). In this context, pseudonymised user profiles are created and cookies (see Cl. 4) are used. The information gained by cookies about how you use this website, such as

  • Browser type/version,
  • Operating system in use,
  • Referrer URL (the web page which directed you to our website),
  • Host name of the accessing computer (IP address),
  • Time of server enquiry,

are transmitted to a Google server in the USA, where they are stored. The information is used to evaluate utilisation of the website, compile reports on the website activities, and to provide additional services related to website and internet usage for the purposes of market research and appropriate presentation of these websites. Where appropriate, this information will also be transmitted to third parties, if this is legally required or insofar as third parties process this data on our behalf. Your IP address will not, in any circumstances, be combined by Google with other data. The IP addresses are anonymised so that they cannot be assigned (IP masking).

You can prevent the installation of cookies by using the appropriate settings of the browser software; please note that in this case, you may not be able to fully use all of this website’s functions.

You can also prevent the capture of the data related to your use of the website generated by the cookie (including your IP address) as well as the processing of this data by Google, by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=de).

Alternatively to the browser add-on, in particular with browsers on mobile terminal devices, you can also prevent the capture by Google Analytics by clicking on this link. This sets an opt-out cookie, which prevents the future capture of your data when you visit this website. II) Google Adwords Conversion Tracking

To statistically capture the use of our website and to assess the optimisation of our website for your use, we also use Google Conversion Tracking. For this purpose, Google Adwords places a cookie (see no. 4) on your computer, provided you have reached our website via a Google ad.

These cookies expire after 30 days and are not intended for personal identification. If the user visits certain pages of the website of the Adwords client and the cookie has not yet expired, Google and the client can see that the user has clicked on the ad and was directed to this site.

Each Adwords client receives a different cookie. Cookies can therefore not be tracked via the websites of Adwords clients. The information gathered by means of the conversion cookies is used to prepare conversion statistics for Adwords clients who have opted to use conversion tracking. The Adwords clients obtain the overall number of users who have clicked on their ad and were directed to a webpage containing a conversion tracking tag. They do not, however, receive any information that would enable them to identify users in person.

If you do not wish to participate in the tracking procedure, you can reject the setting of a cookie - for instance by using the browser setting, which generally deactivates the setting of cookies. Alternatively, you can deactivate cookies for conversion tracking by setting your browser so that cookies from the domain "www.googleadservices.com" are blocked. Social Media Plugins

By virtue of Art. 6(1) (1) (f) GDPR, we use social plugins of the social networks Facebook, Twitter and Instagram on our website, to raise awareness of our offering regarding these. The underlying commercial purpose is to be deemed a legitimate interest within the meaning of GDPR. The responsibility to ensure compliance with data protection laws rests with the respective provider. To provide maximum protection to the users of our website, we integrate these plugins by means of the so-called two-click method.

a) Facebook

Social media plugins by Facebook are used on our website to personalise their use. The "LIKE" or "SHARE" button is used for this purpose. This is an offer provided by Facebook.

When you call up one of our internet pages containing such a plugin, your browser establishes a direct connection with the Facebook servers. The content of the plugin is transmitted by Facebook directly to your browser which integrates it into the website.

As a result of the plugin integration, Facebook receives notification that your browser has called up the relevant page of our website, even if you do not have a Facebook account or are not logged into Facebook at the time. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there.

If you are logged into Facebook, Facebook can directly attach the visit to our website to your Facebook account. If you interact with the plugins, for example click the "LIKE" or "SHARE" button, the relevant information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends.

Facebook may use this information for the purpose of advertising, market research and the needs-based display on the Facebook pages. For this purpose, Facebook creates profiles regarding use, interests and relationships, e.g. to evaluate your use of our website with regard to the advertisements shown to you on Facebook, to inform other Facebook users about your activities on our website, and to provide other services connected with the use of Facebook.

If you do not wish Facebook to attach the data collected via our website to your Facebook account, you must log out of Facebook before you visit our website.

When you call up one of our internet pages containing such a plugin, your browser establishes a direct connection with the Twitter servers. Twitter receives the information that you have visited our site with your IP address. If you click the Twitter "Recommend" button while you are logged into your Twitter account, you can link the contents of our pages with your Twitter profile. This allows Twitter to associate the visit to our pages with your user account. Please note that as provider of the sites, we do not receive any knowledge of the content of the data transmitted, nor its usage via Twitter.

Our website also uses so-called plugins from Instagram, which is operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA („Instagram").

The plugins are identified with an Instagram logo, for example in the form of an "Instagram camera".

When you call up one of our internet pages containing such a plugin, your browser establishes a direct connection with the servers at Instagram. The content of the plugin is transmitted by Instagram directly to your browser and integrated into the webpage. As a result of this integration, Instagram receives notification that your browser has called up the relevant page of our website, even if you do not have an Instagram profile or are not logged into Instagram at the time.

This information (including your IP address) is transmitted by your browser directly to an Instagram server in the USA and stored there. If you are logged into Instagram, Instagram can directly associate the visit to our website to your Instagram account. If you interact with the plugins, for example click the "Instagram" button, this information is also transmitted directly to an Instagram server and stored there.

The information is also disclosed in your Instagram account, where it is displayed to your contacts.

Chats, forums, online games usw.

As part of our products or services, where appropriate, chats/chat rooms, forums, electronic bulletin boards or instant messaging functions are provided to you. Any data and information displayed and disclosed in chat rooms, forums or electronic bulletin boards are also deemed to be public information.

We do not accept any responsibility for saving and storing personal data, which a user discloses to other users or to the public by using the aforesaid functions. When you are deciding whether you display and disclose personal data in public forums, you should exercise caution.

You should also be aware that the data relating to the operation of online games, which is disclosed in the course of multiplayer games (for example the player name and current player statistics) is public data and information, which are also displayed to other users, if appropriate.

Rights of data subjects

You have the right:

  • according to Art. 15 GDPR, to request access to your personal data that are processed by us. You may in particular request information on the purpose of processing, the category of the personal data, the categories of recipient to whom your data has been or will be disclosed, the envisaged period for which the personal data will be stored, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to appeal, the origin of your data, if these were not collected by us as well as on the existence of automated decision-making including profiling and, if appropriate, meaningful information to details regarding the above;
  • according to Art. 16 GDPR, to request the immediate rectification of incorrect or completion of your personal data that is stored with us;
  • according to Art. 17 GDPR, to the erasure of your personal data that is stored with us, where the processing is not required for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;
  • according to Art. 18 GDPR, to request the restriction of processing your personal data, where you are contesting the accuracy of the personal data, the processing is unlawful, and you are opposing the erasure of the data and we no longer require the data, however you require the data for the establishment, exercise or defence of legal claims, or in accordance with Art. 21 GDPR, you have objected to the processing;
  • according to Art. 20 GDPR, to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format or to request the transmission to another controller;
  • according to Art. 7 (3) GDPR, to withdraw your previously provided consent at any time. This will have the effect that we are no longer permitted to continue the data processing, which was based on this consent and
  • according to Art. 77 GDPR, to lodge a complaint with a supervisory authority. To lodge a complaint, you can usually contact the supervisory authority responsible for your habitual residence or place of work or our registered office.

Right to object

If your personal data are processed on the basis of legitimate interests in accordance with Art. 6 (1), sentence 1 (f) GDPR, you have the right in accordance with Art. 21 GDPR, to object to the processing of your personal data, where there are grounds relating to your particular situation, or you are objecting against direct marketing purposes. If the latter is the case, you have a general right to object, which shall be addressed by us without a particular situation being stated.
